Quick Update on the Canadian Anti Spam Legislation


It's been 3 years since CASL came into effect in Canada and the grace period ends on July 1, 2017. I know, it's an icky subject but I want to keep you informed. There's a lot to know but I'll keep this really brief.

Here are the two most important things you need to know about CASL right now.

First, if you own a business and use email for business, every email sent is governed by CASL. It has nothing to do with the application you use, or how many people you send to at a time. Many business people seem to think CASL doesn't apply to them. It definitely does!

Second, the good news. Even though CASL applies to your email communication, unless you have many thousands of subscribers, you're unlikely to ever garner enough attention to warrant an investigation by the CRTC. There is possibly some new legislation coming that will allow civil cases although I have a hard time imagining the grounds for any such cases.

For some businesses, such as mine, it's still important to be compliant with the regulations. If that is also the case for your business, here's a quick and dirty run-down of what most small businesses are missing.

3-Part Memos

The thing I remember most about getting email functionality at work (in 1990, I think) was that I could get rid of those 3-part memos. Some of you will remember them – usually they had ‘Memorandum’ across the top, and places to write your recipient’s name/department, your message, and their reply. They were 3 sheets with carbon paper in between - so you could keep a copy for follow-up and the recipient could write a note to return to you, keeping a copy for themselves. They even folded a certain way for interoffice mail. Yes, they were handwritten! I used the phone a lot more back then. When I wrote those 3-part memos, it was generally for two reasons: to communicate detailed info, and/or to have a record of decisions. When I think of the number of emails I get daily now, and visualize them as a stack of 3-part memos... well, it would be a big stack! Quick Tip - Avoid Hidden Format Problems

When you're inserting content into your newsletter, website or blog, you're often copying it from other documents.  I suggest you always compose in Word (or similar) to take advantage of its spelling and grammar-checking functionality. Your formatting in Word may not be the same as your default formatting in these various applications.  While there are a raft of applications that make it easy now to do your own newsletter, website and blog, most of them are converting your content to html code in the background.  When you copy in text that is already formatted, you're possibly creating problems behind the scenes .  As well, you'll end up with differing fonts and sizes that all have to be corrected before you publish. You can avoid the potential for problems by stripping off all formatting before you paste into the application.  An easy way to do this is to use Notepad (or similar).  You simply open a blank notepad document, paste your con...

Sudden Appearances and Why They May Not Work

Have you noticed a sudden flurry of emails recently? Here are a few examples I've received: The nail technician who I haven't heard from since before the pandemic suddenly shows up telling me she's open for appointments. But not a word earlier about the interruption of service. The leadership consultant who I also haven't heard from since before the pandemic shows up with a newsy, here's-what's-been-happening-in-my-world email that didn't even ask how I'm doing. This was followed by an email every two days to promote her new program. There are no 3-easy-steps to becoming a millionaire. If magic bullets and passive income really existed, we'd ALL be sitting around enjoying the view from our yachts. Cambridge Dictionary defines a 'magic bullet' as "a quick and simple solution to a difficult problem". None of the major dictionaries offer a definition for 'passive income'. That was a Great Conversation But...

Imagine you've just gotten off the phone from a lively conversation with a prospect that lasted an hour. This is Why People Who Subscribe Don't Get Your Stuff

You work hard to attract new subscribers who find value in what you're offering. Someone makes a decision to sign up to your mailing list expecting to receive that great value and... they don't hear a thing from you. I Want to Start Blogging: Now What?

Think of it like learning to drive a car. You’ll need to learn how to drive and you’ll need a car to drive. Which comes first? Some of the learning… the theory part. You can learn about both driving a car and blogging easily enough online. That theory might consist of strategic information, tactics and instructions. Now, it’s hard to go any further without a vehicle. You can borrow a car from a friend, you can rent one, or you can buy one. Likewise, you have 3 options with blogging: Write guest posts for other people’s blogs. You’ll be limited in what you can share, subject to others’ approval and schedule. This option is quick and easy but unreliable as a long-term strategy. Use Facebook Notes or LinkedIn Pulse to publish your articles. You don’t really own them but you can pretend you do. Trying to Unsubscribe

We often talk about the importance of making it easy to unsubscribe. I thought I would share with you my recent experience demonstrating the frustration that can occur when it is not. I decided to unsubscribe from Air Canada's onAir newsletter several issues ago. When my issue arrived, I clicked to unsubscribe and landed on a 'No Update' error page. No big deal, the internet can be glitchy, I would just do it the next issue. This went on for 4 or 5 issues at which point, I started to feel like they were sending me to the error page on purpose. I was getting a little hot under the collar. Last week, on a bad day for me, the current issue arrived and I landed on the same error page. I then went back to the newsletter and clicked the "contact us" link which took me to a form on their website called 'Let Us Know'.
